2. Scope of This Policy
This Privacy Policy explains how we collect, use, disclose, and safeguard Personal Data when you:
- visit or interact with the Site,
- request our marketing services, or
- otherwise communicate with us.
It applies to residents of the United States, the European Economic Area (EEA), the United Kingdom, Canada, and any other region where we operate.
3. Personal Data We Collect
We collect the following categories of Personal Data:
- Identity and contact data: name, company, job title, email address, and phone number. Collected through website contact forms, discovery and intake forms, and client onboarding.
- Technical data: IP address, browser type and settings, device identifiers, operating system, language, and time zone. Collected automatically through cookies, tags, and server logs.
- Usage data: pages viewed, links and buttons clicked, scroll depth, session duration, referring URLs, and the campaign or channel that brought you to the Site. Collected automatically through analytics and measurement technologies.
- Interaction recordings: reconstructions of on-page activity such as clicks, scrolling, and mouse movement, used to diagnose usability problems. Collected automatically through session replay and heat mapping technologies.
- Marketing data: newsletter opt-ins, campaign and advertising interaction history, and email engagement.
- Form interaction data: real-time activity as you complete a form, including which fields you open, how long you spend on each field and step, whether a field receives an entry, how far through the form you progress, and whether you leave without submitting. Collected as you type, separately from and regardless of whether you submit.
- Content you submit: anything you enter into a form or send to us, including free-text answers about your business, goals, timeline, and budget. Where session replay is active, what you enter into a field may be captured even if you never submit the form.
We do not knowingly collect Personal Data from children under 13 and our Services are not directed to them.
4. How & Why We Use Personal Data
- Provide and improve the Services. Responding to enquiries, onboarding, and account management. Legal basis: contract; legitimate interest.
- Marketing and remarketing. Email campaigns, audience building, and showing our advertising on third-party platforms after you visit the Site. Legal basis: consent where required; otherwise legitimate interest.
- Analytics and Site optimization. Measuring traffic, attributing enquiries to the campaign or channel that produced them, understanding how pages are used, analysing how our forms are completed and where visitors drop off, and reviewing interaction recordings and heat maps to fix usability problems. Legal basis: consent where required; otherwise legitimate interest.
- Security, anti-spam, and fraud prevention. Automated bot detection on forms, rate limiting by IP address, log monitoring, and access controls. Legal basis: legitimate interest; legal obligation.
5. Cookies & Tracking Technologies
We track how visitors find and use the Site. We and the providers we engage use first- and third-party cookies, tags, pixels, browser storage, and similar technologies for this purpose. They fall into five categories:
- Strictly necessary. Keep the Site working and secure. This includes access control for gated pages, automated bot and spam detection on forms, and rate limiting by IP address. These cannot be switched off through the Site.
- Analytics and measurement. Count visits, record which pages and links are used, measure page performance, and attribute enquiries to the campaign, referral, or channel that produced them.
- Session replay and heat mapping. Record and reconstruct on-page activity such as clicks, scrolling, and mouse movement so we can find and fix usability problems. These recordings capture how pages are used and may include information you enter into a form on the Site.
- Form interaction tracking. Monitor in real time how our forms are completed, including which fields are opened, the time spent on each field and step, whether a field receives an entry, progress through multi-step forms, and whether a form is abandoned. This runs live as you type, so we may receive information about your progress through a form even if you never submit it.
- Advertising. Build audiences, measure campaign performance, and show you our advertising on third-party platforms after you have visited the Site.
These technologies load on the Site by default and begin collecting shortly after a page opens. We engage a small number of established providers in each category above. We do not publish the individual product names we use, but we will identify the providers that process your Personal Data if you ask, and the categories of recipients are set out in Section 6.
Your choices.
- Most browsers let you block or delete cookies and clear stored site data through their settings. Blocking non-essential cookies will not prevent you from using the Site, though some features may not behave as intended.
- U.S. visitors can opt out of interest-based advertising through industry tools such as optout.aboutads.info and youradchoices.com.
- Visitors in the EEA and UK, and residents of U.S. states with applicable privacy laws, can ask us to stop analytics, session replay, and advertising processing connected to them by emailing operations@socialhabitmarketing.com. We will action the request and confirm once it is done.
Where consent is required for non-essential technologies, we rely on the choices you make through your browser settings and the opt-out routes above. The Site does not currently respond to browser Do Not Track or Global Privacy Control signals. If we introduce on-site consent controls, we will update this Policy and the date at the top of this page.
6. Sharing & Disclosure
We do not sell Personal Data for money. We disclose it only to the following categories of recipients, each of which is engaged under contract and processes Personal Data on our instructions:
- Analytics and measurement providers that report on Site traffic, page usage, and campaign performance.
- Session replay and heat mapping providers that help us diagnose usability problems.
- Advertising and tag management platforms that deliver, target, and measure our campaigns.
- Hosting, infrastructure, and content delivery providers that operate the Site.
- Form, email, scheduling, and client record providers that receive and store your enquiry so our team can respond.
- Security and anti-spam providers that protect our forms and infrastructure.
- Professional advisers, and law enforcement or regulators where disclosure is legally required.
These providers are primarily located in the United States. All are vetted for security and data-protection controls. We will identify the specific providers handling your Personal Data on request at operations@socialhabitmarketing.com.
Some U.S. state privacy laws define “sale” or “sharing” broadly enough to capture the advertising and analytics technologies described in Section 5. If you would rather we did not use them in connection with your visit, you can opt out at any time using the routes in Section 5.
7. How Long We Keep Data
We retain Personal Data no longer than five (5) years after our business purpose is complete, unless a longer period is required by law. Deletion may occur through aggregation, anonymization, or secure destruction within vendor databases.
8. Security
We implement industry-standard safeguards including encryption in transit, access-control policies, and ongoing vendor due-diligence audits. No method of transmission or storage is 100% secure, so we cannot guarantee absolute protection.
9. Your Privacy Rights
Depending on where you live, you may have the right to:
- Access your Personal Data
- Correct or delete it
- Port it to another service
- Withdraw consent at any time
- Opt out of marketing or targeted ads
- Appeal a denied request (Virginia & other U.S. states)
Submit any request to operations@socialhabitmarketing.com. We will verify your identity and respond within the timeframe required by applicable law (30 days for GDPR, 45 days for CCPA/CPRA, etc.).
10. International Data Transfers
We currently store and process Personal Data on servers located in the United States, and we do not transfer EU or UK Personal Data outside your region except through the U.S.-based processor categories described in Section 6. Where such transfers occur, they rely on Standard Contractual Clauses (SCCs) or an equivalent safeguard.
11. Updates to This Policy
We may change this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of the Site after any change constitutes acceptance of the revised Policy.
